Terms of Service

Welcome to Backyard Basketball Association ("BBA", "we", "us", or "our"). These Terms of Service ("Terms") govern your use of backyardbasketballassociation.com and any related services we provide (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms.

If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to create an account or use the Service. If you are under 13, please ask a parent or guardian to register an account on your behalf and supervise your use of the Service.

By registering, you confirm that:

  • You are at least 13 years old.
  • You have the legal capacity to enter into a binding agreement.
  • The information you provide during registration is accurate and truthful.
  • You are not barred from using the Service under the laws of your jurisdiction.

2. Your Account

You are responsible for:

One person, one account. You may not create multiple accounts to circumvent free-tier limits, abuse promotions, or evade enforcement actions.

3. The Service

BBA is a hybrid physical-digital basketball game. Players physically shoot a real basketball, and the Service acts as a digital scoreboard, CPU opponent, and game-management tool. The Service is provided "as is" and is intended for entertainment and recreational fitness use.

We may add, remove, modify, or discontinue features at any time without prior notice. Where reasonably possible, we will give advance notice of material changes that affect paid subscribers.

4. Free and Premium Accounts

The Service offers two tiers:

  • Free accounts include access to core gameplay with advertising, a single save slot, and a subset of statistics features.
  • Premium accounts remove advertising, increase save slots, and unlock additional features. Premium subscriptions are billed on a recurring basis (monthly or annually) and renew automatically unless cancelled.

Current pricing is displayed at the time of purchase. We may change pricing for new subscribers at any time. Existing subscribers will be given advance notice before any price increase applies to their plan.

5. Payment, Billing, and Cancellation

Premium subscriptions are processed by Stripe. By subscribing, you authorize us (through Stripe) to charge your payment method on a recurring basis until you cancel.

  • Renewal: subscriptions renew automatically at the end of each billing period using the payment method on file.
  • Cancellation: you may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period — you keep premium access until then.
  • Refunds: except where required by law, payments are non-refundable. We may, at our sole discretion, offer a refund or credit in cases of billing error, service outage, or other extenuating circumstances.
  • Failed payments: if a renewal payment fails, we may downgrade your account to the free tier until payment is successfully collected.
  • Taxes: prices are exclusive of applicable taxes. You are responsible for any taxes owed on your purchase.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to gain unauthorized access to any account, system, or data.
  • Probe, scan, or test the vulnerability of the Service or circumvent any security measures.
  • Use any automated means (bots, scrapers, crawlers) to access the Service, except for public search-engine indexing or with our prior written permission.
  • Reverse-engineer, decompile, or disassemble any part of the Service, except as expressly permitted by applicable law.
  • Interfere with or disrupt the Service, our servers, or any other user's enjoyment of the Service.
  • Upload or transmit viruses, malware, or any other malicious code.
  • Harass, threaten, or abuse other users or our staff.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Use the Service to violate any applicable law, regulation, or third-party right.

We may suspend or terminate your account immediately if you violate this section.

7. User-Generated Content

If the Service allows you to create content — for example, custom team names, profile information, or comments — you retain ownership of what you create. By submitting content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute that content solely for the purpose of operating and improving the Service.

You are responsible for the content you submit and represent that you have all necessary rights to do so. You may not submit content that is illegal, infringing, defamatory, hateful, harassing, sexually explicit, or otherwise inappropriate, especially given the family-friendly nature of the Service.

8. Intellectual Property

The Service, including its software, design, logos, text, graphics, audio, and all other content (excluding user-generated content) is owned by BBA Games, LLC or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

All team names, logos, and other in-game branding are fictional and original to BBA. Any resemblance to real-world sports franchises, names, or marks is coincidental.

9. Physical Activity Disclaimer

BBA involves physical activity — shooting and handling a real basketball in your own physical environment. By using the Service, you acknowledge and agree that:

  • Physical activity carries inherent risks of injury.
  • You are solely responsible for ensuring your playing area is safe, free of hazards, and appropriate for the activity.
  • You play at your own risk and are responsible for your own physical condition, equipment, and surroundings.
  • Children should be supervised by a responsible adult during gameplay.
  • You should consult a physician before beginning any new physical activity if you have health concerns.

BBA is not responsible for any injury, property damage, or other harm arising from gameplay.

10. Termination

You may delete your account at any time through your account settings or by emailing support@backyardbasketballassociation.com.

We may suspend or terminate your account, with or without notice, if:

  • You violate these Terms.
  • We are required to do so by law.
  • The Service is discontinued.
  • We have a reasonable belief that termination is necessary to protect the Service, its users, or third parties.

On termination, your access to the Service ends. Provisions of these Terms that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will remain in effect.

11. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.

We do not warrant that the Service will be error-free, secure, or always accessible. We are not responsible for data loss, missed gameplay, or other harm caused by service interruptions.

12. Limitation of Liability

To the fullest extent permitted by law, BBA Games, LLC and its officers, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or physical injury, arising out of or related to your use of the Service.

Our total aggregate liability for any claim arising out of or related to the Service will not exceed the greater of: (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars (US$100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

13. Indemnification

You agree to defend, indemnify, and hold harmless BBA Games, LLC and its officers, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your violation of any third-party right, including intellectual property or privacy rights.
  • Any content you submit to the Service.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of North Dakota, United States, without regard to its conflict-of-laws principles.

Any dispute arising out of or related to these Terms or the Service will be resolved in the state or federal courts located in North Dakota, and you consent to the personal jurisdiction of those courts.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we update the version number and effective date at the top of this page. Material changes will be communicated by email or by an in-app notice, and where required, we will ask you to re-accept the updated Terms before continuing to use the Service.

Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

16. Miscellaneous

  • Entire agreement: these Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.
  • Severability: if any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force.
  • No waiver: our failure to enforce any provision is not a waiver of our right to do so later.
  • Assignment: you may not assign or transfer these Terms without our prior written consent. We may assign these Terms freely.
  • No third-party beneficiaries: these Terms do not create any rights for any third party.
  • Headings: section headings are for convenience only and do not affect interpretation.
